Good question. This does slightly depend on what you mean by infringed.
Advertisers cannot use the trademark in the advert, they can only bid on the name, so they will still be restricted and as such this should help your quality score against theirs.
Some companies do not bother trade marking their names and use the ‘passing off’ legislation instead. Google is under legal pressure in the US regarding this change.
I’m afraid I don’t know the answer to the patented question, maybe someone else can help with this.
